By using RussianMix.com (“RM”) and its content, products and services (collectively, the “Services”) offered on or through the site you agree to be bound by the following Terms of Service (“TOS”). This service agreement may be updated and modified at any time and without notice to the registrant. Unless explicitly stated otherwise, any new features that augment or enhance the current Services shall be subject to the TOS.
Description of Service
The Services are a combination of content that we create and also content created by third parties. Some Services provide you and other users with an opportunity to submit, post, display, transmit and/or exchange information, ideas, opinions, photographs, images, video, creative works or other information, messages, transmissions or material to us or others on or through that Service (collectively, the "Postings").
While we use every reasonable effort to provide informative and relevant content as part of the Services, you may nevertheless be exposed to content that you find offensive, indecent, objectionable or that may be inaccurate. You bear all risks associated with using such content. You understand that the Services are provided by RM “AS IS”. We do not guarantee 100% accuracy, integrity or quality of any content available on or through the Services. You acknowledge that you may not rely on any of this content, whether created by or submitted to us, including, but not limited to book reviews, photos, event postings, or literary quotations.
You understand that from time to time, you may communicate with, receive communications from, or use the services and/or products of the third parties (e.g., advertisers) as a result of your use of the Services. All such communication, interaction and participation is strictly and solely between you and such third party and RM shall not be responsible or liable to you in any way in connection with these activities or transactions. You are also responsible for obtaining access to the Services and that access may involve third party fees (such as Internet service provider or airtime charges).
Member Conduct
You understand that all information, data, text, software, music, sound, photographs, graphics, video, messages or other materials ("Content"), whether publicly posted or privately transmitted, are the sole responsibility of the person from which such Content originated. This means that you, and not RM, are entirely responsible for all Content that you upload, post, email, transmit or otherwise make available via the Service.
You agree that you will (i) not interfere with another registrant’s use and enjoyment of the Services; (ii) not interfere with or disrupt the security measures of the Services; (iii) not interfere with or disrupt networks connected to the Services, and will comply with all regulations, policies and procedures of such networks.
You agree to not use the Services to (i) send or otherwise transmit junk e-mail, chain letters, duplicative or unsolicited messages, or any other "spam"; (ii) harm minors; (iii) promote or generate revenue for any business or commercial purposes, whether or not for a charge or through linking with any other web services or pages, unless authorized by RM; (iv) impersonate any person or entity; (v) intentionally or unintentionally violate any applicable local, state, national or international law; (vi) "stalk" or otherwise harass another; (vii) collect or store personal data about other users; or (viii) express or imply that any statements are endorsed by RM unless we have provided you with prior written consent permitting you to make such statement.
Postings
You understand that you are solely responsible for all Postings and other materials, whether publicly posted or privately transmitted, that are uploaded, posted, emailed, transmitted or otherwise made available from your email address on or through the Services. You further agree that your Postings will not violate the TOS. Specifically, your Postings will not contain any material that (i) is false, inaccurate, or misleading; (ii) infringes any third party's copyright, patent, trademark, trade secret or other proprietary rights, or rights of publicity or privacy; (iii) violates a nondisclosure agreement, or violates any law or regulation (including, without limitation, those governing export control, unfair competition, or false advertising); (iv) is defamatory, constitutes trade libel or product disparagement, or is unlawfully threatening or harassing; (v) is obscene or contains child pornography; (vi) is offensive or sexually suggestive or (vii) contains viruses or computer programming routines that may damage or interfere with the operation of any system, or unlawfully intercept any data or personal information.
Additionally, you will not (i) reproduce, distribute, republish or retransmit material posted by any other Services users without the permission of that user and RM; (ii) take any action that imposes an unreasonable or disproportionately large load on our infrastructure; or (iii) interfere or attempt to interfere with the proper working of the Services, any activities conducted on or through the Services, or any networks through which you access the Services.
You specifically grant to RM a perpetual, worldwide, royalty-free, irrevocable, nonexclusive right and license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform and display all Postings submitted by you or through your account, in whole or in part, and to incorporate them in other works in any form, media or technology now known or later developed throughout the universe. You also give RM permission to copy your Postings as part of the normal backup process and to archive discussions containing your Postings.
Registration
You may sign up as a registered user of the Services without paying any fees to RM. At the time of registration, you agree to provide accurate, up to date, and complete information about yourself, and further agree to revise your information in order that it continues to be accurate, up to date and complete. You agree that we may rely on the information you provide us. We reserve the right to terminate your use of the Services for any reason whatsoever, including but not limited to, you providing us with false, misleading or dated information about yourself. For more detailed information about how we treat the registration information you provide to us, please see our Privacy Policy, which is incorporated by reference into these TOS (and therefore a part of your agreement with us).
If we issue you a password, you agree to help protect your information by guarding that password, and by changing it as soon as possible if you believe its security has been compromised. If RM allows you to choose a username and you select, in our sole discretion, one that is obscene, indecent, abusive or which is otherwise objectionable, RM has the right, without prior notice to you, to automatically change your username, delete your Postings under it, deny you access to the Services, or any combination of these options. You may not transfer your registration, password or user name to another person or share it with anyone. We will not be responsible for any loss or damage that may result if you fail to comply with these requirements. If you believe your information has been used without your authorization, you agree to notify RM immediately.
Copyright
All the materials on this site, including, but not limited to text, graphics, icons, and software are the property of RM. The materials are protected by United States and international copyright laws. The compilation of all content on this site is the exclusive property of RM. Without our written authorization, you may not reproduce, modify, distribute or republish materials contained on this site (either directly or by linking), nor may you alter or remove any trademark, copyright or other notice from copies of content. Material may be downloaded from the site only for your personal, noncommercial use. We reserve all rights in and title to all material so downloaded. All trademarks, service marks, trade names, trade dress and logos appearing on the site are the property of their respective owners.
Copyright Infringement
We are not liable for any infringement of copyright arising out of materials posted on or transmitted through our site, or items advertised on the site, by end users or any other third parties. In the event that you believe that your rights in copyright are being violated by any materials posted or transmitted through our site, contact us as soon as possible in order that an investigation be commenced and, if necessary, block or remove the infringing materials.
Service Deactivation or Termination
We have the right, but not the obligation, to take any of the following actions in our sole discretion at any time and for any reason without giving you any prior notice (i) restrict, suspend or terminate your access to all or any part of our Services; (ii) refuse, move or remove for any reason any material that you submit on or through the Services; (iii) refuse, move, or remove any content that is available on or through the Services; (iv) deactivate or delete your accounts and all related information and files in your account.
We may take any of the above actions for any legitimate business reason, as determined by RM in its sole discretion, including, but not be limited to, (a) breaches or violations of the TOS or other incorporated agreements or guidelines, (b) requests by law enforcement or other government agencies, (c) a request by you, (d) discontinuance or material modification to the Services (or any part thereof), and (e) unexpected technical or security issues or problems. You agree that we will not be liable to you or any third party for taking any of these actions
